Terms of service

These terms govern the Clarifyd portal and the services delivered through it. They are between you and KYCK GRC Services Pty Ltd (ABN 71 676 098 650), trading as Clarifyd.
What we provide
- ClariCheck — an AML/CTF risk assessment of a person or business you name, based on documents and information you provide, evaluated against published typologies and reviewed by an analyst.
- ClariID — AML screening (PEP and sanctions), standard identity checks with AML screening, and biometric checks on people you name, carried out through our verification provider, APLYid. If a standard or biometric check is flagged, we review it and tell you the outcome. Access is not automatic: it requires an application and our approval, because our provider’s terms bind us to who holds that access and why.
What an assessment is, and is not
An assessment is our analyst’s opinion of risk, formed on the material available at the time, against typologies published by AUSTRAC and others. It is a professional judgement, not a statement of fact about anyone, and not a finding of wrongdoing.
It is not legal advice, financial advice, or a substitute for your own AML/CTF programme. If you are a reporting entity, your obligations under the AML/CTF Act — including customer due diligence, ongoing monitoring and reporting suspicious matters — stay yours, and nothing we provide discharges them.
If you are checking someone for yourself, the decision to deal with them is yours.
We do not advise on building or maintaining a compliance programme.
What we need from you
- That you have a genuine reason to assess or verify each person you submit, and the authority to give us their information.
- That each person you submit has been told their information is being given to us, or there is a lawful reason not to tell them. Our privacy page explains what we do with it.
- That anyone you send a biometric check to, or run a standard check on, has agreed to it. Standard checks and AML screening run without contacting the person.
- That what you give us is complete and accurate as far as you know. An assessment reflects what it was given; material you withhold changes the answer.
- That you keep your account credentials to yourself, and tell us promptly if you think someone else has them.
You must not use Clarifyd to assess or verify someone without a legitimate reason — including out of curiosity, or to look into someone you are not dealing with or considering dealing with. We may suspend an account we believe is being used that way.
Turnaround
Each assessment has a target time: 5pm the next business day, or earlier with priority handling. Times are Brisbane time, and business days exclude weekends and national public holidays. The clock pauses whenever we are waiting on something from you, and resumes when you answer.
Target times, including priority handling, are what we work to, not guarantees. Fees are not refunded if a target is missed. This doesn’t affect your rights under the Australian Consumer Law.
A matter left unanswered for an extended period is parked, and you will be told before that happens.
Fees
Assessments and identity checks are charged at the price shown before you commit. Prices include GST. Payment is taken at submission — an assessment begins when it is paid, because analyst time begins then.
If you need a tax invoice, email hello@clarifyd.com.au and we’ll send you one.
If you abandon a matter after submitting it, we assess what we were given rather than refunding it: the work has been done. If we cannot deliver at all, you are refunded in full. This doesn’t affect your rights under the Australian Consumer Law.
Your material and ours
What you upload stays yours. You give us permission to use it only to deliver the service you asked for, and we do not use your customers’ documents to train models.
The report we produce is yours to use for the purpose you obtained it — your own compliance file, your own decision, and your regulator. It is not for resale or publication.
The portal, the indicator catalogue and the report format remain ours.
Availability
We do not promise the portal is available at all times. We will avoid taking it down without notice where we reasonably can, and we keep working on it while you use it.
Liability
Nothing here excludes rights you have under the Australian Consumer Law that cannot be excluded. Where our liability can be limited, it is limited to re-supplying the service or refunding what you paid for the matter concerned.
We are not liable for a decision you make about a client. Deciding whether to act for someone, and on what terms, is yours.
Closing your account
You can stop using Clarifyd at any time. We may suspend or close an account that breaches these terms, or where we are required to.
Closure does not delete assessments already issued: both of us may need that record, and the retention described in our privacy page continues to apply.
Changes and law
If we change these terms materially we will tell account holders before the change takes effect. They are governed by the law of Queensland, Australia.
